End User License Agreement
Please read this End-User License Agreement carefully before downloading or using the 420 Kingdom application.
Interpretation and Definitions
Agreement means this End-User License Agreement between You and the Company regarding use of the Application.
Application means the 420 Kingdom software program downloaded through an Application Store.
Application Store means the Apple App Store or Google Play Store.
Company refers to 420 Kingdom Inc., 901 Potato Road, Arvin, CA 93203.
Device means any device used to access the Application.
You means the individual or entity accessing or using the Application.
Acknowledgment
By downloading or using the Application, you agree to be bound by this Agreement. This Agreement is between You and the Company only — not with the Application Store. The Application is licensed, not sold, to You.
You confirm that you are 21 years of age or older (or 18 or older with a valid California medical cannabis recommendation), located in California, and legally permitted to purchase cannabis products.
License
The Company grants You a revocable, non-exclusive, non-transferable, limited license to download, install and use the Application for personal, non-commercial purposes strictly in accordance with this Agreement.
License Restrictions
You agree not to: license, sell, rent, or distribute the Application; copy it for unauthorized purposes; modify, reverse engineer, or disassemble any part of it; or remove any proprietary notices.
Content Restrictions
You are solely responsible for content you post through the Application. You may not transmit unlawful, offensive, defamatory, or otherwise objectionable content. The Company reserves the right to remove content and revoke access for violations.
Intellectual Property
The Application and all related intellectual property rights remain the sole and exclusive property of the Company.
Third-Party Services
The Application may include or link to third-party content or services. The Company is not responsible for any third-party services, including their accuracy, legality, or quality.
Modifications to the Application
The Company may modify, suspend, or discontinue the Application at any time without liability. Updates may change or remove features and are subject to this Agreement.
No Warranties
The Application is provided "AS IS" without warranty of any kind. The Company disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The Company does not warrant that the Application will be uninterrupted, error-free, or free of harmful components.
Limitation of Liability
The Company's total liability under this Agreement is limited to the amount actually paid by You for the Application, or $100 USD if nothing was paid. The Company is not liable for indirect, incidental, or consequential damages.
Indemnification
You agree to indemnify and hold the Company harmless from any claim arising from your use of the Application, your violation of this Agreement, or your violation of any third-party rights.
Term and Termination
This Agreement remains in effect until terminated. The Company may terminate immediately for any breach. Upon termination, you must cease all use and delete all copies of the Application.
Severability and Waiver
If any provision is found unenforceable, it will be modified to the minimum extent necessary. Failure to enforce a provision does not constitute a waiver.
United States Legal Compliance
You represent that you are not located in a US-embargoed country and are not on any US government restricted-parties list.
Governing Law
This Agreement is governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in Kern County, California. As a licensed California cannabis retailer (DCC License No. C12-0000405-LIC), all activities under this Agreement are subject to California cannabis regulations.
Changes to this Agreement
The Company may modify this Agreement with at least 30 days' notice for material changes. Continued use after revisions take effect constitutes acceptance.
